Nefse Terms of Use

1. Parties and acceptance.: These terms are between the person using the Nefse app (“you”) and the app’s developer, Orhan Semiz (sole proprietorship; “Eftelya App” on the app stores). These terms apply while you use Nefse; you can review them before using the app. If you downloaded the app from the App Store, Apple’s standard End User License Agreement (EULA) also applies.
2. What Nefse is, and what it is not.: Nefse is an app that offers adults who want to quit smoking daily support, tracking and relaxation tools. Nefse is not a medical device; it does not provide diagnosis, treatment, medication or professional healthcare services, and it does not replace them. The health information in the app is general information based on sources such as the World Health Organization; it is not a personal measurement or prediction.
3. Emergencies.: If you feel you are in danger or have an urgent health problem, do not turn to the app; call 112 (the emergency number in Türkiye) immediately. For support with quitting smoking, you can call the Turkish Ministry of Health’s ALO 171 helpline.
4. Age.: You must be at least 18 years old to use Nefse.
5. Right to use.: You are granted a limited, non-transferable right to use Nefse for personal, non-commercial purposes. Copying or modifying the app, reverse engineering it, or using or distributing its images, texts and designs without permission is prohibited. The app’s name, images, texts and code belong to the developer.
6. Your data.: The records you enter in the app are yours and are stored only on your phone (see the Privacy Policy). If your phone is lost or damaged, or you delete the app without having made a backup, your records cannot be recovered; the developer cannot access these records and therefore cannot restore them. We recommend backing up regularly with “Download my data”.
7. Price.: This version of Nefse is free; there are no ads and no in-app purchases. If an optional paid membership is added in the future, the price, trial period, renewal and cancellation terms will be shown clearly before purchase, and these terms will be updated. The core tools that help you quit smoking (I’m struggling, breathing, urgent support, counter) will remain free.
8. Limitation of liability.: Nefse is provided “as is”. The developer does not guarantee that the app will run without interruption or error, or that you will achieve any particular result in quitting smoking. To the extent permitted by law, the developer cannot be held liable for indirect damages arising from use of the app. This clause does not restrict your rights under Turkish Consumer Protection Law No. 6502.
9. Notifications and reminders.: Notifications are created on your phone and depend on your settings. A notification may be delayed or may not arrive because of phone settings, battery saving or the operating system; do not rely on notifications alone for your health or safety.
10. Changes and termination.: The developer may update these terms; significant changes will be announced in the app and the effective date will change. You can end your use at any time by deleting the app.
11. Governing law.: These terms are governed by the laws of the Republic of Türkiye. As a consumer, for disputes within the scope of Law No. 6502 the Consumer Arbitration Committees and Consumer Courts have jurisdiction.
